Temp vs Permanent: Making the Right Choice for Your Circumstances
The choice between temporary and permanent work is not straightforward. Both have genuine advantages and drawbacks, and the best option depends on your personal circumstances rather than a blanket rule.
Understanding the Legal Framework
As a temporary (agency) worker, you are employed by the agency, not the company where you work. Key legal points:
- Agency Workers Regulations (AWR): after 12 weeks in the same role with the same client, you are entitled to equal pay and conditions with permanent staff
- Holiday pay: accrued at 12.07% of hours worked. May be paid weekly ("rolled up") or accrued to be taken as paid leave
- Pension: auto-enrolment applies after the qualifying period
- Sick pay: SSP (£116.75/week in 2025/26) after 3 waiting days, if you meet the earnings threshold
The Pay Question
Temporary work often pays a higher hourly rate, but permanent work has hidden value:
- Temp: higher hourly rate, but no paid holidays, no company sick pay, no guaranteed hours
- Permanent: lower hourly rate, but paid holiday (28 days), company sick pay, pension contributions, and income stability
- When you factor in 28 days of paid holiday, a permanent salary of £26,000 is roughly equivalent to a temp rate of £13.50/hr with no paid leave
When Temp Work Makes Sense
- You want flexibility around other commitments (childcare, study, caring responsibilities)
- You are trying out different industries or companies
- You need to start earning immediately
- You want higher hourly rates and are willing to trade stability for them
- You are between permanent roles and need income
When Permanent Makes Sense
- You want a predictable income for mortgage or rent
- You value sick pay and pension benefits
- You want career progression within a company
- You prefer routine and knowing your schedule in advance
- You want employer-funded training (CPC, forklift, etc.)
The Temp-to-Perm Route
A popular middle ground: start as a temp, prove yourself, and convert to permanent.
